Welcome to Throne and Liberty Guild Manager (TLGM)! TLGM is a web application designed to help you manage guilds within the MMORPG Throne and Liberty. By using TLGM, you agree to abide by these Terms of Service (the "Terms") that govern your use of our service. Please read them carefully.

Acceptance of Terms

By accessing or using TLGM, you agree to be legally bound by these Terms, whether or not you have created an account. If you do not agree to any of these Terms, do not use TLGM.

User Accounts

• Discord Login: To use TLGM, you must sign in using your Discord account. You are responsible for maintaining the security and confidentiality of your Discord credentials.
• Account Security: Immediately notify us if you suspect any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to maintain your account security.

Permissions Management and Data Responsibility

• Permission Management: Guild owners and administrators are solely responsible for managing member permissions within their guilds. This includes carefully assigning, monitoring, and revoking access rights to guild features and data.
• Data Modifications: Any changes made to guild data (including but not limited to DKP adjustments, member management, item assignments, and activity records) by users with appropriate permissions are considered authorized actions.
• No Data Recovery: TLGM does not maintain backups for individual guild actions and cannot restore data modified or deleted by users with valid permissions, even if such actions were made with malicious intent.
• Security Best Practices: We strongly recommend:
  • Regularly reviewing member permissions
  • Immediately revoking access for departing members
  • Limiting administrative access to trusted individuals
  • Maintaining your own records of important guild data
• Liability: TLGM is not liable for any loss, damage, or disruption caused by authorized users misusing their permissions or by guild administrators failing to properly manage access rights.

Subscriptions and Payments

• Plans and Payments: TLGM offers different subscription plans with premium features. Payment is processed exclusively through LemonSqueezy.
• Unlocking Features: Premium features will become available after successful LemonSqueezy payment.
• Changes to Plans: TLGM reserves the right to modify, update, or remove subscription plans or features. Notice of significant changes will be provided via email or through the app.
• Cancellations and Refunds:You can cancel your subscription at any time through LemonSqueezy or within the app. Refunds are available according to our refund policy.

Refund Policy

• Subscription Cancellation: You may cancel your subscription at any time. Upon cancellation:
  • Your subscription will remain active until the end of the current billing period
  • No partial refunds are provided for unused portions of the billing period
  • You will retain access to premium features until the end of your paid period
• Refund Eligibility:
  • Within 48 hours of purchase: Full refund if no premium features were used
  • Accidental Purchases: Must be reported within 24 hours of purchase
• Non-Refundable Circumstances:
  • After premium features have been actively used
  • Cancellations after the first 48 hours
  • Account terminations due to Terms of Service violations
  • Claims made after the billing period has ended
• Refund Process: To request a refund:
  • Contact us through our Discord support channel
  • Provide your account details and reason for refund
  • Refunds are processed through LemonSqueezy to the original payment method
  • Processing time may take 5-10 business days
• Service Termination by TLGM: If we terminate your service due to violations of our Terms:
  • No refund will be issued for the current billing period
  • Future scheduled payments will be cancelled
  • Access to premium features will be immediately revoked

Usage Guidelines

To ensure a safe and productive environment, please follow these rules while using TLGM:

• Acceptable Use:You agree to use TLGM only for managing your guild activities within Throne and Liberty.
• Prohibited Behaviors: Do not engage in activities that include, but are not limited to, hacking, harassment, spamming, or unauthorized access.

Modifications to the Service

TLGM is constantly evolving, and we may change or discontinue certain features at any time. We will provide notice for significant changes that might impact your use of the service.

Limitation of Liability

• TLGM is provided "as is" without warranties of any kind, whether express or implied.
• We are not liable for indirect, incidental, or consequential damages arising out of or in connection with your use of TLGM.

Governing Law and Jurisdiction

These Terms are governed by the laws of Chile. Any disputes arising from these Terms or your use of TLGM shall be resolved exclusively by the courts located in Araucanía Region, Chile.

Data Ownership and Privacy

• User-Generated Content: While you retain ownership of your content, you grant TLGM a worldwide, non-exclusive license to use, store, and display your content for the purpose of providing and improving our services.
• Data Export: You may export your guild data at any time through our export features, some of them which are under construction. We recommend regular exports for your records.
• Data Retention: We may retain your data for a reasonable period after account closure for backup, archival, or audit purposes.

Service Availability and Support

• Uptime Commitment: While we strive for high availability, we do not guarantee 100% uptime. Scheduled maintenance will be announced in advance through our Discord server.
• Technical Support:
  • Support is provided through our Discord server
  • Response times are not guaranteed
  • Premium subscribers may receive priority support
• Service Interruptions: We are not liable for any damages or losses resulting from service interruptions, including those caused by:
  • Scheduled maintenance
  • Third-party service failures
  • Force majeure events
  • Internet connectivity issues

Intellectual Property Rights

• TLGM Property: All rights, title, and interest in TLGM, including software, features, and documentation, remain exclusively with us.
• Feedback: Any feedback, suggestions, or ideas you provide may be used without any obligation to compensate you.
• Trademark Usage: The TLGM name, logo, and any related marks are our trademarks and may not be used without prior written permission.

Rate Limits and Fair Usage

• API Usage: We implement rate limiting to ensure fair usage of our services. Exceeding these limits may result in temporary service restrictions.
• Resource Limits:
  • Excessive resource usage may be throttled
  • Automated access must be pre-approved
• Account Restrictions: We reserve the right to limit or suspend accounts that negatively impact service performance for other users.

Third-Party Integrations

• Discord Integration: Our service relies on Discord for authentication and certain features. Changes to Discord's services may affect TLGM functionality.
• Payment Processing: Payment processing is handled by LemonSqueezy. Your payment information is subject to their privacy policy and terms.
• Third-Party Liability: We are not responsible for the availability or functionality of third-party services integrated with TLGM.
